“Some Brokerage firms and stockbrokers have allegedly misrepresented to investors that the VIX, which is known for trading on volatility, was a safe investment,” said Attorney Mark A. Over-concentration of a customer’s investment account in any one sector of the market, or product, like the VIX Futures, dramatically increases the risk of loss to the investor,” Mr. Tepper added.
“According to the rules that govern the securities industry, if a stockbroker misrepresents the level of risk or fails to disclose the true speculative nature of a recommendation, this may provide a reasonable basis for recovery,” Mr. Tepper said.
